China’s Legal Tradition and Its Modern Transition

Chinese law has a long history and can be divided into two main stages: the traditional law period and the modern-contemporary law period. The Chinese legal system, developed during the traditional period, embodies the characteristics of the combination of ritual and law, the family standard, and the unity of nature and man. The modern-contemporary legal system is the result of transplants and borrowing from other legal systems and it developed into a socialist legal system with Chinese characteristics. Traditional law has a great influence on contemporary times and constitutes the key to understand contemporary trends.

Guest Speaker Chen Xinyu, Associate Professor. He received his Bachelor (1999) and Master of laws (2002) degrees from China’s University of Political Science and Law. He obtained his Ph.D. from Peking University (2005). He has taught at Tsinghua Law School since 2005 and is currently the Director of the Institute for Law and Modernity. He was a visiting scholar at Meijo University in Japan (2007-2008) and University of British Columbia in Canada (2018-2019). Associate Professor Chen’s research focuses on Chinese legal history, comparative law and legal ethics.
